These Terms & Conditions (“Terms”) govern the purchase and use of products and services offered by Motrix Designz (“Motrix Designz”, “we”, “us”, or “our”).

By placing an order with Motrix Designz, accessing our website, or purchasing or using our products, you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree with these Terms, you should not place an order or use our products.

1. DEFINITIONS

For the purpose of these Terms:

“Customer”, “you”, or “your” means the person or entity purchasing or using our products or services.

“Product” means any physical product, component, accessory, part, merchandise, or other item offered by Motrix Designz.

“Show Product” means a product specifically identified by Motrix Designz as being intended for display, show, exhibition, competition, demonstration, collection, private-property use, or other non-public-road purposes.

“Website” means any website, online store, social-media shop, or other online platform operated by or on behalf of Motrix Designz.

“Order” means a purchase request submitted by the Customer for one or more Products.

2. GENERAL

These Terms apply to all purchases made from Motrix Designz unless expressly agreed otherwise in writing.

Motrix Designz reserves the right to update, amend, or modify these Terms from time to time. The version applicable to an Order is the version in effect at the time the Order is accepted, unless otherwise required by applicable law.

Certain Products may be subject to additional product-specific terms, instructions, warnings, or restrictions. Such terms form part of these Terms.

3. PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to ensure that product descriptions, photographs, specifications, dimensions, colours, finishes, and other information displayed by Motrix Designz are accurate.

However, minor differences may occur due to manufacturing tolerances, lighting, photography, screen settings, materials, finishes, or product updates.

Photographs and visual representations are for illustrative purposes unless explicitly stated otherwise.

Motrix Designz reserves the right to modify product specifications, designs, materials, colours, packaging, or features where reasonably necessary, provided that such changes do not materially affect the Product purchased.

4. PRODUCT AVAILABILITY

All Products are subject to availability.

If a Product becomes unavailable after an Order has been placed, Motrix Designz may contact the Customer regarding the situation and, where applicable, offer an alternative, delay delivery, or issue a refund.

Motrix Designz reserves the right to limit quantities or refuse orders where reasonably necessary, subject to applicable law.

5. ORDERS

Submitting an Order constitutes an offer by the Customer to purchase the selected Products.

An Order is not necessarily accepted merely because it has been submitted or an automated confirmation has been received.

Motrix Designz may accept or reject an Order at its discretion, subject to applicable consumer protection laws.

An Order becomes binding when Motrix Designz confirms acceptance of the Order or otherwise clearly confirms that the Product has been accepted for fulfilment.

Motrix Designz reserves the right to cancel an Order where there is a genuine error in pricing, product information, availability, suspected fraud, payment issues, or other legitimate circumstances.

If an Order is cancelled after payment has been received, the relevant amount will be refunded where applicable.

6. PRICES

All prices displayed by Motrix Designz are stated in the applicable currency and may be subject to applicable taxes, VAT, shipping charges, customs duties, or other charges.

Unless explicitly stated otherwise, shipping costs are not included in the displayed Product price.

Motrix Designz reserves the right to change prices at any time. Price changes will not affect Orders that have already been accepted, except where required by law or where an obvious pricing error has occurred.

7. PAYMENT

Payment must be completed using the payment methods made available by Motrix Designz.

An Order may not be processed until payment has been successfully received or otherwise authorised.

If a payment is reversed, declined, charged back, or otherwise not successfully completed, Motrix Designz reserves the right to suspend or cancel the relevant Order.

The Customer must provide accurate and complete payment and billing information.

8. SHIPPING AND DELIVERY

Motrix Designz will make reasonable efforts to dispatch Products within the estimated delivery period communicated to the Customer.

Delivery times are estimates unless a specific delivery date has been expressly guaranteed in writing.

Delivery may be affected by circumstances outside our reasonable control, including carrier delays, customs procedures, weather, strikes, shortages, technical problems, or other unforeseen events.

The Customer is responsible for providing an accurate delivery address.

Motrix Designz is not responsible for delays or failed delivery resulting from incorrect or incomplete information provided by the Customer.

Where applicable, the Customer may be responsible for customs duties, import taxes, clearance fees, or other charges imposed by the destination country.

9. INTERNATIONAL ORDERS

Customers ordering Products for delivery outside the country in which Motrix Designz operates are responsible for ensuring that the Products may legally be imported and used in the destination country.

Import regulations, vehicle regulations, certification requirements, taxes, duties, and product restrictions may differ between jurisdictions.

Motrix Designz does not guarantee that a Product is legal, certified, approved, registrable, or suitable for use in every country.

10. RETURNS AND CANCELLATIONS

Consumers may have statutory rights to cancel or return an Order under applicable consumer protection legislation.

Where a statutory right of withdrawal or cancellation applies, Motrix Designz will comply with the applicable legal requirements.

Certain Products may be excluded from cancellation or return where permitted by law, including Products that are custom-made, personalised, modified according to Customer specifications, or otherwise fall within a lawful statutory exception.

Nothing in these Terms is intended to remove or restrict any mandatory statutory consumer rights.

For returns, the Customer must follow the return instructions provided by Motrix Designz.

Products should be returned in accordance with applicable return requirements and, where reasonably possible, in their original condition and packaging.

11. CUSTOM AND MADE-TO-ORDER PRODUCTS

Products manufactured, modified, personalised, painted, engraved, configured, or otherwise produced specifically according to Customer requirements may be considered custom or made-to-order Products.

Because such Products are produced specifically for the Customer, cancellation or return rights may be limited where permitted by applicable law.

The Customer is responsible for providing accurate specifications, measurements, colours, designs, logos, text, and other information required for custom Products.

Motrix Designz is not responsible for errors resulting from incorrect information supplied by the Customer.

12. PRODUCT USE AND INSTALLATION

The Customer is responsible for ensuring that Products are installed, maintained, stored, transported, and used correctly.

Where professional installation is recommended or required, the Customer should use an appropriately qualified professional.

Motrix Designz shall not be responsible for damage resulting from incorrect installation, misuse, negligence, improper maintenance, unauthorised modification, or failure to follow supplied instructions.

13. SHOW / DISPLAY PRODUCTS

Certain Products sold by Motrix Designz are specifically intended for show, display, exhibition, competition, demonstration, collection, private-property, or other non-public-road purposes.

Not all Motrix Designz Products are subject to this restriction.

Where a Product is identified by Motrix Designz as a Show Product, the Customer acknowledges that the Product is supplied for the stated show/display purpose and may not be legally suitable or approved for use on public roads.

14. PUBLIC ROAD USE

A Show Product must not be used on public roads, public highways, public streets, or other areas subject to public-road regulations unless the Customer has independently confirmed that such use is legal and the Product has all approvals, registrations, certifications, equipment, and requirements legally required for that use.

Unless expressly confirmed otherwise in writing by Motrix Designz, Motrix Designz does not represent or warrant that a Show Product is road legal.

If a Customer chooses to use a Show Product on a public road or in any other location where such use is prohibited or restricted, the Customer does so entirely at their own risk.

To the maximum extent permitted by applicable law, Motrix Designz shall not be responsible for fines, penalties, vehicle seizure, accidents, injuries, property damage, insurance issues, loss, legal consequences, or other consequences arising from the unlawful, unauthorised, or improper use of a Show Product.

15. ROAD LEGALITY AND COMPLIANCE

The Customer is solely responsible for determining whether a Product complies with the laws and regulations applicable to its intended use.

This may include, without limitation:

• Road-legal requirements
• Vehicle registration requirements
• Technical inspection requirements
• Safety regulations
• Lighting requirements
• Noise regulations
• Emissions regulations
• Insurance requirements
• Certification requirements
• Type approval requirements
• Import requirements
• Local and national vehicle regulations

Motrix Designz does not guarantee that a Product will meet the requirements of any specific country, region, authority, inspection agency, insurer, or registration system.

16. MODIFICATIONS

Any modification, alteration, cutting, welding, drilling, painting, electrical modification, mechanical modification, installation of additional components, removal of components, or other alteration performed by the Customer or a third party is carried out at the Customer's own risk.

Unauthorised modification may affect the Product's safety, functionality, warranty, certification, or legality.

Motrix Designz shall not be responsible for damage, failure, injury, accident, or loss caused by unauthorised modifications, except where liability cannot legally be excluded.

17. SAFETY

The Customer must read and follow all available installation instructions, warnings, safety information, and product-specific requirements before using a Product.

Products must not be used in a manner contrary to their intended purpose.

If a Product appears damaged, defective, unsafe, or improperly manufactured upon receipt, the Customer should discontinue use and contact Motrix Designz.

18. WARRANTY AND STATUTORY RIGHTS

Motrix Designz aims to supply Products of satisfactory quality and in accordance with applicable legal requirements.

Where a commercial warranty is expressly provided for a Product, the terms of that warranty will apply in addition to any mandatory statutory rights.

Nothing in these Terms excludes or limits statutory guarantees, warranties, or consumer rights that cannot legally be excluded or limited.

Warranty claims may require reasonable evidence of purchase and, where relevant, photographs, videos, product information, or other information necessary to assess the claim.

Warranty coverage may not apply to damage caused by misuse, negligence, accidents, unauthorised modifications, improper installation, abnormal use, or failure to follow instructions, to the extent permitted by law.

19. INTELLECTUAL PROPERTY

All intellectual property rights relating to Motrix Designz's branding, logos, names, designs, photographs, graphics, product descriptions, website content, software, text, and other materials remain the property of Motrix Designz or its respective licensors.

No Customer is granted any licence or right to reproduce, copy, distribute, modify, sell, publish, or commercially exploit such materials without prior written permission.

The Motrix Designz name, branding, logos, designs, and other intellectual property may not be used in a way that suggests an unauthorised affiliation, sponsorship, partnership, or endorsement.

20. CUSTOMER-SUPPLIED MATERIALS

If the Customer provides Motrix Designz with photographs, designs, logos, artwork, text, measurements, or other materials for the purpose of creating a custom Product, the Customer confirms that they have the necessary rights to provide and use such materials.

The Customer is responsible for ensuring that supplied materials do not infringe the intellectual property, privacy, trademark, copyright, or other rights of third parties.

The Customer agrees to indemnify Motrix Designz against claims arising from materials supplied by the Customer, to the extent permitted by applicable law.

21. WEBSITE USE

The Customer agrees not to misuse the Motrix Designz website or attempt to interfere with its operation.

This includes attempting to gain unauthorised access, introducing malicious software, scraping protected information, interfering with security systems, or using the website for fraudulent or unlawful purposes.

Motrix Designz reserves the right to restrict access to the website where reasonably necessary to protect the website, its users, or the business.

22. PRIVACY AND DATA PROTECTION

Motrix Designz may collect and process personal information required to process Orders, provide customer support, communicate with Customers, process payments, deliver Products, and comply with legal obligations.

Personal information will be handled in accordance with applicable data protection and privacy legislation and Motrix Designz's applicable Privacy Policy.

23. THIRD-PARTY SERVICES

Motrix Designz may use third-party providers for payment processing, shipping, website hosting, communication, analytics, marketing, or other business functions.

Where third-party services are used, their own terms and policies may also apply.

Motrix Designz is not responsible for circumstances outside its reasonable control caused by independent third-party service providers, subject to applicable law.

24. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Motrix Designz shall not be liable for indirect, incidental, special, consequential, or economic losses arising from the purchase or use of Products.

This may include, where legally permissible:

• Loss of income
• Loss of profits
• Loss of business
• Loss of use
• Loss of opportunity
• Vehicle downtime
• Third-party claims
• Fines or penalties
• Insurance consequences
• Damage resulting from unauthorised modifications or misuse

Nothing in these Terms excludes or limits liability for matters that cannot legally be excluded or limited under applicable law.

25. CUSTOMER INDEMNIFICATION

To the maximum extent permitted by law, the Customer agrees to indemnify and hold harmless Motrix Designz, its owners, employees, representatives, and contractors from claims, losses, damages, liabilities, costs, or expenses arising from the Customer's unlawful, negligent, improper, or unauthorised use of Products.

This provision does not apply to the extent that the relevant loss was caused by circumstances for which Motrix Designz is legally responsible.

26. FORCE MAJEURE

Motrix Designz shall not be responsible for delays or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control.

Such circumstances may include natural disasters, war, civil unrest, government action, strikes, supply-chain disruptions, transportation failures, power outages, cyber incidents, pandemics, shortages of materials, manufacturing disruptions, or other unforeseen events.

Where reasonably possible, Motrix Designz will take appropriate steps to minimise the impact of such events.

27. COMPLAINTS

Customers should contact Motrix Designz as soon as reasonably possible if they have a complaint regarding an Order or Product.

Complaints should include the relevant Order information and a clear description of the issue.

Motrix Designz will make reasonable efforts to investigate and resolve legitimate complaints in accordance with applicable law.

28. FRAUD AND ABUSE

Motrix Designz reserves the right to investigate and take appropriate action against suspected fraudulent activity, payment abuse, false claims, abusive returns, chargeback abuse, or other misuse of our services.

Where permitted by law, Motrix Designz may refuse or cancel Orders associated with suspected fraudulent or unlawful activity.

29. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary to make it enforceable where legally possible.

The remaining provisions shall continue in full force and effect.

30. NO WAIVER

Failure by Motrix Designz to enforce any provision of these Terms shall not constitute a waiver of the right to enforce that provision in the future.

31. ASSIGNMENT

The Customer may not transfer or assign their rights or obligations under these Terms without prior written consent from Motrix Designz, except where such restriction is prohibited by applicable law.

Motrix Designz may transfer or assign its rights and obligations where reasonably necessary for business operations, restructuring, merger, acquisition, or transfer of assets, subject to applicable law.

32. CHANGES TO PRODUCTS AND SERVICES

Motrix Designz reserves the right to modify, discontinue, replace, or update Products and services at any time.

Such changes will not affect Orders that have already been accepted except where permitted or required by applicable law.

33. GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws applicable to Motrix Designz, unless mandatory consumer protection legislation requires otherwise.

Nothing in this clause limits any mandatory rights or protections available to consumers under the laws of their country or place of residence.

34. JURISDICTION

Any dispute arising from these Terms or an Order shall be subject to the competent courts of the jurisdiction applicable under mandatory law.

Where legally permitted, disputes may be brought before the competent courts in the jurisdiction where Motrix Designz is established.

Consumers retain any mandatory rights to bring proceedings before the courts available to them under applicable consumer protection law.

35. ENTIRE AGREEMENT

These Terms, together with any applicable product-specific terms, written Order confirmations, warranties, and policies expressly incorporated into them, constitute the agreement between the Customer and Motrix Designz concerning the relevant purchase.

Any additional terms proposed by the Customer shall not apply unless expressly accepted in writing by Motrix Designz.

37. ACCEPTANCE OF TERMS

By placing an Order with Motrix Designz, the Customer confirms that they have had the opportunity to read these Terms and agrees to be bound by them to the extent permitted by applicable law.

For Products specifically identified as Show Products, the Customer additionally acknowledges and accepts the restrictions regarding public-road use and assumes responsibility for ensuring that the Product is used only in accordance with applicable laws and regulations.

Motrix Designz reserves the right to provide additional product-specific warnings, instructions, or restrictions where necessary.
